Question about neighbors

Here is my problem i live on 7 acres of land. And i normally ride my go kart with my friends. Well about two years ago they put up a housing dev next to me.

There is a wood fence all the way down dividing my property from the housing dev.

Well my problem is the house next to me over the fence the people in that house stated that the go kart is to loud and they would call the cops.

Now i know i am not breaking any laws because it is on private property and i dont start driving my kart until 12pm and i always stop around 6pm never drive it past 6pm. And i think noise ordnence starts at 7pm in florida? I never start it at 6am always around 12pm or later.

I have lived here for 10 plus years and never had any problems until that housing dev went up.

And i try to be nice to them but there just nasty to me always throwing there stuff over the fence. Beer bottles yard trimming and such.

So anyways has anyone here ever had this same problem?

I think there just pissed because we wont sell to the housing dev. And its a older housing dev they just added a new section with newer houses.

I am only having problem with that one house the rest of the houses along the fence the people are nice.

My friends has a buttcrack for a neighbor too.

Talk to the "higher ups" about it. If your on your property I dont think the cops could do anything about it. Maybe you could report them for harassment or something?

And if theyr dumping crap on your property you need to do something about that too.
Although glass bottle make nice for target practice!

First off, If you're not pushing into the noise ordinance and are on your own property, (and not in the public right-of-way), you're not breaking any laws.

Secondly, you need to call the cops on them for throwing their beer bottles and slippings on your property. By doing that they are littering, which IS breaking a law.

Ride on!!

I'm the type of person that don't like to stir up trouble. My wife has told me to call on them for that. But i would figure by now they would stop. We just got the kart for my son and me to have some fun on. It's not even that loud. Was thinking of getting a muffler to silence it a little bit.

Thanks for the replies guys. Yea we are not in the public right of way. And i don't think we are breaking any noise ordinance laws.

If they are dumping trash on your property you need to call the police. If you aren't breaking a noise ordinance don't feel sorry. It's your property and your rights, stick to them or they mean nothing.

Beer bottles in the yard? That's a major ***hole move on their part, I'd be pretty annoyed with the concept of broken glass all over my lawn/property (I'm known to walk around barefoot sometimes)

What you're doing sounds perfectly legal to me, so long as you obey the noise ordinance and you're on your own property. Maybe if you're riding around with no muffler or something and near the houses a lot you could be considerate and do something about it, but I don't believe you would be obligated to in any way.

I would check with the local constabulary to find out what the noise laws are in your neck of the woods.
It could be that you can make as much noise as you want.
Then again...there may be limits as to minimum distance from your neighbors according to what the decibel level coming from your engine is.

Yes but put yourself in his shoes. He lived their originally and hes getting stuff flung at him and into his yard. I don't understand why people cant simply walk over and have a peaceful conversation something along the lines " Hey, I just wanted to let you know that go kart you own is quite loud I was wondering if there was anything you could do to maybe make it quieter?"

While it's nice to try to be courteous to your neighbours, there are limits. Like Russ suggested, getting a professional opinion on the local law is a good idea. I don't know how long this has been going on but I'm wondering if you've had any surprise visits from the police yet? Surely if you're breaking the law, you would.

Anyways, back to the limits thing- What if you were doing construction? Would the noise be okay? What if you were cultivating your field? Would the noise then be okay?

I have precious little patience for people that insist on being a pain in the @ss just for the sake of it. I live in a rural community. Come harvest time, the local farmers do their thing until dark, sometimes later. The harvesters are pretty loud, and sound travels well around here. Do I complain? No. Why? I have better things to do with my life than exist to be a thorn in someone's side. It's not intolerably loud inside the house, so why cause a fuss?

I think at this point, the people in question are just complainers by nature, maybe even jealous. If you are not breaking any laws, then to he// with them. Sure, be nice- put a quieter pipe on, it's a nice thing to do. But you have rights, too.

I have a neighbour close enough to me that the noise from my kart could conceivably bother him. In fact, after I built my custom muffler I went out of my way to show it to him and ask him repeatedly if it bothered him. Did I mention he's a cop? He swore up and down that he'd let me know if it became a problem. It's been a year since I did that. Now here's a guy living right next to me, keeping odd shifts (cop) sometimes sleeping in the daytime, with all the power in the world to put a stop to my fun (cop). Here's me with a custom exhaust that HAS to be louder than stock. No problem. Go figure. Why? 'Cause the guy's not a jerk.

This kind of reminds me of some people that live in proximity to Toronto's international airport, and insist upon complaining about the noise. Umm- DUH!!!

Now, the littering? I'd let it be for a bit, and then if they don't chill out with the noise complaints, I'd call the police myself and have a littering discussion...

Ethereal_Corpse What part of Florida, I am Myself is from Kissimmee Florida [Kinda around celebration area]. Were you live kinda sounds like a place near me, were they put up Apartments. and a bunch of large land owners that own dirtbikes/ATVs/Go-karts some even having their own tracks are now getting *****ed at. because some bright idea decided to build somewhere without checking on the locals first.

Osceola Cops are jerks so if you live in Osceola, just prevent any way you can to not get the cops called, because they like to make up story's and try to get both parties in trouble... With your luck and them, you'd get arrested for something that has nothing to do with what they were called for!

here is how it is if your doing it the way you say you are if the cops come let them tell you the law if that cops dont tell you anything thin let them suck on your jackshaft if your being nice and their still nasty let the cops sort it out

Be the bigger man and try and quiet your motor. If they throw stuff, harass you, or give you a hassle, call the police immediately!!! Littering is illegal. Harassment to you OR your property is illegal. You are already putting your best foot forward by complying with noise statutes and trying to be generally polite overall. If they throw stuff on your property, try and get it on video. Personally, I'd pound their door down for a little chat if I witnessed them do that to me.

Plan 'B' - run them out of town. Make it absolutely unbearable for them to live there. May take awhile, but highly effective.

If you're not breaking any laws, there is little your neighbors can do besides act like jerks.

My 2 cents worth (much of which has already been said):
Even though it's the neighbors who are being jerks -
Put a good muffler on it.
Maybe (if possible) move your riding area away from the side the jerks live on.
Find out EXACTLY what the noise ordinance says, some are very specific as to Db levels, others pretty vague. Also find out what the "Nuisance" ordinance says.
If push comes to shove , it'll be to your advantage to be able to show you're in compliance with both ordinances and have made reasonable efforts to accommodate your neighbors.
You may want to spend a few bucks and get one of the less expensive surveillance cameras. If you have video of the jerks tossing stuff in your yard, that's just more in your favor.
Unfortunately, this is often a result of people who move "to the country" and then want the country to be what they want instead of what it is....and it's not usually like what they see in Southern Living or Martha Stewart magazines.

I once lived in a rural community (middle of nowhere, actually) where the philosophy was "If you mind your business, I'll mind mine and we'll both be happy". A developer put some big buck houses in. Within 6 months the "come here's" were at the County meetings complaining about people working on cars in their yards, campers parked behind houses, and a variety of piddly things including the stereotypical but true "fridge on the front porch". They had been sold a vision of the country that didn't exist but they were determined to make it so. They were somewhat successful in their efforts as they paid big property taxes, and more than a few were "people who know people". They were also successful in getting 95% of the locals to regard them as @$$holes and give them the cold shoulder....not that it mattered as they didn't want to associate with "the rednecks" anyway.
But no, we didn't throw our trash in their yards.
The ditch in front of their houses was a different story and their mailboxes caught hell....































Just kidding about the ditch and the mailboxes.
One of their houses did burn down, but it wasn't us, the owner did that his own self.
BTW - one other thing I learned living there:
If you live at the bottom of a hill, and someone living there that maybe "ain't all there" really pisses someone else off by pointing a gun at them in a beer store parking lot, an 11.00-20 truck tire rolled from the road down said hill will clear the front porch steps in one bounce, peel off your porch light, come in the front door and sit on the sofa beside you.
You won't get much sleep that night, as you'll be up on the roof watching the highway through a scope.
Ah, the good old days.....

iv never lived closer than 130km from a town so the way i do things is very differant and when i stay in town i get funy looks from people wondering who the noisy bugger driving a toyota with no lights hasnt realisd hes got neibours

ussually the rednecks come from the country but in your case it seems the respectable people wanting to get on with life have had the rednecks move in

personally id do stuff like kill a sheep and accidentally leave the guts outside there fence for a week too long
or post them said guts

but as said many times say with the law as your best bet

also surly there would have been some type of paperwork go thought the local council or shire office like the enviromental policy and stuff like that

try and see if it says anything about the houseing estates impacts on the existing residents like your way of life will not be affected or u can continue with your everyday practices

ultimately u were there first and the neibours need to harden the **** up

My 2 cents...first thing you need to do is to slide by the local cop shop and talk to them. That way you know where you stand and what to expect if the neighbor does call the cops.

Putting a quieter muffler on the cart is all fine and dandy, but I don't think that is going to help in this case. It sounds like the neighbor just has a bug up his *** and isn't going to be happy no matter what you do.

I bet even if you get rid of the cart they'll just find something else to complain about.

why not call the cops on them when they mow their lawn???? absolute bs.

exactly what is harming them by driving your go kart? WTF?
