From what I can tell it is a Baja MB165, this is my first Mini Bike fixing it up for the kids to ride around the yard. Before I go purchasing parts can someone please confirm model. Also can the engine be upgraded? Thanks for the replies and was glad to find this cool forum.

Welcome! Cool bike!
That is a good motor ( a classic with many upgrades ) and super easy to work on.

Edit: just noticed it was a 3.5hp,thought it was a five., so can still pull some decent hp from that.

The stock engine on those bikes is a 5.5hp or 6.5hp Honda clone. You now have a 3.5hp Briggs flathead. Also stock was a bolt on jackshaft that provided a 2:1 reduction. You need that jackshaft or you will burn up that clutch. You can get the jackshaft for $60. I'd get a Predator for it will you're at it. In stock governed form, these only do 20-25mph but they get there pretty quick.

You'd still need the jackshaft or get a TAV. Your clutch is probably a 10t and the rear sprocket is a 50t I believe and that doesnt fair well with a 19in diameter tire.

The guy I bought this from said the gas tank was from an Harley Sportster, he modified it to fit, does anyone know where I can get a gas cap for it?

Should be painting this week

That doesn't look right for a normal Sportster tank bung to me... Sort of looks like an early style that someone has 'modified'. Check ebay, but I'm thinking you'll have to weld some new bungs in there.
