Since my Baja Warrior has a vehicle cert. Ive been running the roads on it all weekend pushing my luck with the county sheriffs n such. They put up a sign stating " all vehicles including 4 wheelers must stay on pavement". It even has a city ordinance #. Im testing their resolve. :2guns:
If im correct, and I think I am. City laws/codes trump state and even county laws as long as they remain constitutionally legal. The area im riding in is annexed by City of Tyler as far as roads are concerned. Any thoughts?

IMO... if there is no GS(Government Statute) code at the bottom of the sign... its a custom/private sign... in other words... NOT official. So all Ill say is its probably not city NOR county that will uphold what it says... due to the fact that unless you pay a DOT tax on your vehicle... 'by law', its not suppose to be on DOT roads.

... and who knows when 'that' ordnance was passed... in the city/town I live in, there's an ordnance to give each released inmate a horse w/ saddle, and a silver dollar... never changed. I know 2 ppl that have gotten a horse that way... and yes that means I know criminals.... lol.

IDK.....I would go down to city hall....look up code enforcement. ...and ask to see that # that was listed......if it's on the books....it doesn't matter who put the sign up....when.....or why.

Now half.....I don't know about where you live....but where I do. ..there aren't sidewalks everywhere. ...so I guess the ladies are supposed to push the strollers in the grass?????

But DYK...bicycles are technically classified as motor vehicles and are supposed to follow the same rules as cars????

What about cop cars? Other government vehicles? City construction equipment like backhoes or street sweepers???

So there are at least a few exceptions to the above. ....

That is crazy....and a good way to get a horse. You could then sell it for a couple of $$

I was talking bout what the judge/magistrate 'could' consider as 'law', if he/she were to be under Federal authorization(judge by the books). "If" there is a GS code at the bottom of the sign... it's a recognized mandate for the sign to be in that location by a federal law... stop/no parking/yield/speed limit/etc(stationary road signs).

(not sure what this has to do w/ the price of tea in China... but)Yea we have side walks... but in the 30 yrs ive lived here... not once have I ever seen anyone pushin a stroller down one... but I have seen a mother draggin her kid by the hair kickin and screamin down the side of the road once... no sidewalk, in the dirt.

Yes I know bicycles are considered to follow the same rules as cars... but lets see how fast you get 'pulled over' for driving one down the middle of a County road(one of the reasons for the space between the yellow line and the 'actual' edge of the road (no taxed zone... area where non taxed vehicles maneuver)). So if a judge were to let someone go for driving their go kart down the road because, the sign said to do so, the judge would be in the wrong(under Federal law), cause federal law trumps ALL city/state laws... but $$$ talks and lawyers gladly take a chunk of the 'law' bending/overlooking.(e.i- how many ppl have you ACTUALLY ever heard of someone paying the 250K for playing mailbox baseball... I didnt... but it 'did' come up as a subject when I went for my Federal clearance for a contract job overseas...lol still got it though....)

What about cop cars? Other government vehicles? City construction equipment like backhoes or street sweepers???... they are all 'governed' under city/state/local officials as state owned vehicles... plus 'those' folk are the ones that have something to do w/ the 'official' sign being put in the location in the first place.

All Im saying is the signs w/ a GS code are definitely to be followed...If no GS code... it's to be respected. However, if it's a law and a non GS code sign says to 'break the law', you have little to worry about from the cops, for ignoring the sign, due to the fact that by following the sign, you would be breaking the law, vs. a 'rule' set aside by someone of lesser authority than the federal government.

The horses/saddles were branded w/ a seal stating pretty much the same thing as it was a state owned horse and couldnt be sold... and they only had em for 30 days before the city put up a fine for having a horse in city limits w/out a permit... plus those things are EXPENSIVE to keep up round here... darn near 1K a month not counting the annual 'fee'... the 2 horses are now under the supervision of the local police dept(their ridden round main st).

I called our Code Compliance office and inquired. They refered me to the City Water Department. Doesn't make sense unless you take into account these roads surround a lake. The city Water department says, any vehicle not registered and inspected may operate "In" the park. But they have to be hauled in. So I can't ride the roads around the lake but I can ride in the parks upto county roads allowing access to the parks.
I was also asked during my call if I was out there this weekend on a wide wheeled mini bike painted black with no exhaust. It seems even the sheriffs had a question re: all this and called them earlier this morning. This describes my Baja Warrior pretty well. I didn't confess to anything, but was told it needed a muffler if i knew the person. I thanked them for the info. Less than 10 minutes on the phone and it cleared up a lot. Looks like I'll be avoiding and fines or jail time by just riding across a few yards ive already been granted access to to get to the park. And I'll be installing a muffler to meet noise ordinance.
