need suggestions for dealing with a bad neighbor

I've heard of and read posts about nightmare neighbors before but have never had to deal with anything like what we have now. Technically this jerk isn't an immediate neighbor but he lives close and his crappy behavior affects the entire neighborhood.



His name is **** ******* and as of this post he is approximately 54 years old. He inherited the home in our neighborhood from his mother and has had no need to work since he simply moves in working girlfriends and has them pay the utilities and taxes. (No skin in the game if you will) He's lived here for a long time and has been the reason behind hundreds of calls to local police precinct.



Most of the neighbors in this area are owners, several of which are original owners. Not too shabby for a 40 year old development in North Phoenix.



When I moved in approximately 5 years ago he was in the prime of his "paint" phase. This included spilling and sloshing paint from water bottles and "red solo cups" onto our sidewalks, driveways, mailboxes, streets, and walls (both home and perimeter). His real beef at the time was any vehicle parked in the street at night. He would splash paint on our cars or swipe the length of the cars with a paint marker (and he got my wife's one night). We had a backyard neighbor who was renting and told me lived in South Phoenix his whole life. This neighbor and Eric had several confrontations over the paint and I believe that caused Eric to stop with the paint.



Yes we call the police, yes they come out, **** doesn't answer his door and there is nothing the police can do since we don't have video or photo evidence.



A couple of years ago he moved to his trash phase. He would literally drop his garbage bags in the street where we all enter the neighborhood or simply dump them out on the asphalt from the bag. Some neighbors would take it and throw it in his yard. I'm not sure what curbed that but whatever.



More recently he was in a glass bottle phase. He was breaking (mainly Heineken) bottles right on the street where we all enter/exit the 'hood. That's where I got involved. I started writing him letters and returning the glass to his driveway. That seemed to stop that phase.



One neighbor told me last night she filed a restraining order against him weeks ago and police were only able to serve him this past week because he never answers his door. Here's some irony though- HE is the guy that calls the police when we rip karts around the 'hood. HE calls the police to complain of noise if anyone is socializing in their own yards late at night, even when noise volumes are reasonable. And it was a noise complaint he filed the other night that had officers go to his home and serve the restraint.



Since he was served, he's moved to an egg phase. He's throwing eggs at everything, especially cars parked in the street and that's where we are now. I left him another note addressing the eggs and I must stress, my notes have all been polite. I've never name called, I've always used phrases like "We are asking you to please stop..." We'll see what this note does.



This is clearly a behavior issue. Maybe he's handicapped, maybe not. I could care less, we all just want it to stop. So what do we do? Must we all install expensive security camera equipment to catch it on film? Do we follow him to a store and beat the teeth from out of his head? What are your thoughts/suggestions? I'm raising young children here as are many others. How do we solve this problem?

... i had a neighbor that broke glass in the road... Id sweep it up n place piles of broken glass behind his car ties, n pour alil cement n water on the pile... he eventually stopped feeding my ammo when the solid mass of glass n cement hindered him drivin outta his driveway...

... gallon of gas n a match w/ a delayed igniter on yard trash does wonders when the fire dept n police issue a health hazzard warrent to clean up or vacate...

... cuttin of any length of exposed phone line makes reattachment annoying n alil hard to call bout noise pollution... even though there is a certain time period where the restrictions are normally not applicable....

Id say I was joking... but I'm not...

Sounds mental.... Talk to the office of mental health and retardation. He might need a "check up"..... They can issue a warrant to have him hospitalized for evaluation. You and your neighbors got to do it together though.
Definitely get cameras..... Why have you not already? Put your car at the end of the driveway. Put camera on it.... Tempt him.... Bait him to vandalize it..... Now you got proof and he goes to jail.....
I'm quite peaceful man, but what you described that he did, I'd have kicked his ARSe by now. Couple times..... :2guns:
Go on a hunt. Get picture proof.... He can not lie if a pic shows his actions....
Now I didn't say to do this, but I know a good way to scare him..... Pour gas onto his yard... Spell out "your dead" or something..... That's it..... NO fire.... The gas kills the grass and he will have to look at it for a week or more..... And it slowly kills it, so if he catches you in the yard, he can't see what you did.... Use a 2 litter bottle with a hole in the cap so you can aim/write the letters clearly....

Okay.. I don't know how you should handle this.. because I know you shouldn't handle this like I would.

But just a word of caution, in germany you could get in real trouble posting his name in your post...
IDK, but I guess it's nearly as bad in the US.. so you maybe should remove his name at least his last name, noone around here would know him anyways;
and if he's as much of a jerk as you say he is.. he might google his name regularly...;)

I grew up in Phoenix. Most of my family is still there. Anyway, I too had a neighbor that was absolutely impossible here in Iowa. I delt with that deadbeat for 5 years before he was finally kicked out by his grandparents because of all the complaints and ordinance violations/fines they were getting. Although I cant speak of the frustration of eggs, glass, and paint. This guy was the worst I ever had to deal with. We kept calling the city and getting ordinance violations on record, After a few years of the city doing absolutely nothing I had my lawyer file a suit against him for public nuisance. After 5 years courts and the city finally helping out. The city came in took all his crap that was outside sent him a bill for cleaning the property and overnight he was gone. I feel your pain. Every moment that I saw him I had to fight back the urge to whip his ***. Best of luck!!

all i can say is keep the law on your side, try to get video evidence of him vandalizing your property so you can take him to court, even motion sensor game camera's could get some still frames catching him in the act, any kind of evidence you can... if you step outside the law in dealing with him you're the same as him in the eyes of the police, or even worse, you become the bad guy

In this instance since I was bored I spent maybe 5 minutes and have an idea... supermanotorious, is he across the street that's behind your house, about 3 houses to the south? :cheers2:

But uhh, as far as actually sticking it to him -- I agree with game cams. As far as 'real' surveillance systems go, you'd have to spend a good bit of money to get enough clarity for a positive ID, unless you film him leaving his house... and specifically surveilling someone else's property is rather inadvisable.

I wouldn't retaliate in any illegal manner, he may be crazy enough to have surveillance and catch you in the act. As said.. I'd get some good security cameras and catch him in the act.

thanks for the ideas guys, believe me I am peaceful but do run with some rough bikers and not because I'm a journalist, beating his *** would give me blissful satisfaction but I don't think that will help in the long run, I just hate that we have to spend $$ on cameras to catch him in the act, do you think once it's over we could sue him for the cost of time and equipment to catch him?

I use trail cameras for security surveillance. I only use those with infrared flash (invisible to the human eye). Pictures are sharp, clear, and have a date and time stamp. Most can be set to shoot stills and video. You can now even get a type which wirelessly sends video to your cell or home computer. Maybe get the neighbors together to fund the purchase of 2-3 of these cameras. Be very careful with threats, either covert or blatant: you could be charged with terroristic acts - and guilty or not, this will tie you up in the legal system for years, and you are not likely to recover the expense of your defense.

The trail cams are available from Cabelas. Bass Pro, and just about any outdoor store that caters to hunters. You can also opt for the remotely triggered GoPro type of video camera: http://www.sweetwater.com/store/detail/GoProRemote2

Ok so I removed his name, I don't need him figuring out which house is writing him notes and soon will be causing him headaches. I'll certainly see if the nabes want to chip in on equipment. I also think I'll periodically post Craigslist ads with his address as a free place to dump fill dirt and rock in the front yard, I like your suggestions, keep em coming!

That could work in your favour; bikers don't usually have a problem "stretching" the law but, I'm not suggesting you do anything like have a bunch of them sit outside his house making lots of noise & tyre smoke; if there's nothing to identify them (ie: no colours), what can he do?

It would be nice if you could do something like that, it would make the point "you're messing with the wrong people"...

Nope. The logic behind it is really hard to explain, but a good way to think about it is this: You're getting the camera because of the prior paint/glass/egg throwing. Since he hasn't been convicted of those actions, you cannot claim that the camera was purchased because of him. Therefore the camera is essentially a form of self-insurance, which bears cost whether used or not and cannot be claimed as damages.

Of course, there's nothing stopping you from reselling the equipment once you're done with it which would at least recoup some of the cost... but it sounds to me like you'd want to hold on to it, at least until he moves out.
