Worcester Mass,i have been riding my mini chopper on the streets for about
10 years now,get pulled over a few times each year.Never got a ticket.
The mini choppers seem to fit the definition of a moped yet most cops do not seem to know this until they read the registration.I get [Moped Sticker]$40.00 every 2 years.Just picked 2 more choppers off creigs list already bought [Moped Stickers]for them. One is a clutched 4 speed[worried about that] though i will ride it anyhoo.
The 1st picture[the black bike][4 speed semi auto] is the one i have been riding for the past 10 years. The 2 other bikes are my new ones.
Orange one is [clutched 4 speed]Blue one [4 speed semi auto.]
All 48/49 cc.Dressing them up a bit this winter.

According to Massachusetts law

According to Massachusetts law, a moped is a "motorized bicycle." In order to be classified as a moped, the vehicle must:

Have a cylinder capacity of no more than 50 cubic centimeters.
Have an automatic transmission.
Be capable of a maximum speed of no more than 30 miles per hour.
Comply with all applicable federal motor vehicle safety standards.

A moped sticker, issued by the RMV, must be affixed to the moped. This sticker will not be issued unless the vehicle meets the above requirements.
Operating Requirements

Moped operators are subject to the traffic laws, rules and regulations of the Commonwealth.

Mopeds will have the right to use all public ways in the Commonwealth, except limited access or express state highways where signs prohibiting bicycles have been posted.

Mopeds may use bicycle lanes next to various ways but are excluded from off street recreational paths.

Moped operators must signal their intention to stop or turn by using either hand.

Mopeds may keep right when passing a motor vehicle which is in the travel lane of a way.
Restrictions When Operating a Moped

Mopeds will not be operated:

By any person under 16 years of age.
By any person who does not have a valid license or permit.
At a speed greater than 25 miles per hour.
Without the operator and any passenger wearing a DOT standard helmet.

non-pedal bicycle which has a motor,

In Mass.the semi automatic[no clutch] choppers fit the definition.
Other states are more specific.
Take Georgia Moped Laws for instance.States,
and does not require clutching or shifting.
Take Kentucky Moped Laws.,States,
an automatic transmission not requiring clutching or shifting by the operator after the drive system is engaged.

Even though in Mass. states,Be capable of a maximum speed of no more than 30 miles per hour...................
Below that it states,Mopeds will not be operated:
At a speed greater than 25 miles per hour.............
As long as you are not clocked above 25 MPH
your ok.
And about the peddles.
On the registration it says this.
Definition:
According to Massachusetts law (M.G.L. Chapter 90 Section 1), a "motorized bicycle" (also known as a
“moped”) is defined as a pedal bicycle which has a helper motor, or a non-pedal bicycle which has a motor,

Michigan's rules are about the same, except NO gears are allowed (torque converter only).

I bought my son one of these:

49cc, but had 4 speeds and a clutch. Never had a problem with the cops- and we live 2 blocks from the station.

As long as you don't drive like a jerk, you won't attract attention.

Interesting thing in Michigan- those electric scooters that look like Sprees do not need to be registered at all, as long as they have operational pedals. Down side- stock they only hit 18mph.
