We run go karts on our own property. The sheriff comes every Saturday night with a complaint from our neighbors. We live on 5 acres outside of the city, outside of the village, but in a township. Can they really shut us down?! This sucks!

First: talk to your neighbors.. invite them in for a ride ;)
ask when they would allow that kind of fun etc.

If that doesn't help, ask your local sheriffs department under what cicumstances you are legally allowed to drive your karts on your own property...

(it's almost always about noise!)

I agree! Part of our frustration is the "calls" are anonymous! We would love to have our neighbors get hooked! We all took the muffler challenge this week, fabricated and trialed our results in search of the quietest cheapest option! Truth be told my lawn mower registers louder on my decibel app now than the kart!
Stay tuned! We will see what Saturday night brings!

OK! Point taken. Here's the update... for 5 bucks we added mower mufflers and started karts at 7:30 by 8:30 the sheriff got the call! Looks like we will be making a trip to the Township Hall meeting as a guest!

I wasn't gonna say anything but, honestly, if I was in your neighbours position, I'd probably call the cops too. There's a time & place for everything & 8:30 at night is not the time to be running go karts...

It sucks to have the cops called on you when you are aren't doing anything "wrong". I mean there are criminals out there. However "wrong" can be subjective. My example, I'm fortunate, I live in a small town and everyone here has an atv of some sort and we all go all over town and nobody says a word. Just keep it considerate. However one of my neighbors got an old honda awhile back and he ONLY rode it at 2 am, never in the day and people complained, including me.

Fabroman... thank you for the feedback. Thats what we need. To understand what "reasonable" is. The definition by law, no surprise, is un-usefully vague and defined by surroundings. Since we are in the country surrounded by farming machinery much louder and long winded than our Saturday fun.
We thought "reasonable" in our community was dark. I am surprised to hear you say 8:30. Can you tell me what would be reasonable in your opinion? We want to be good neighbors but feel we should be able to run our carts on our five acres outside of the city, even the village.

Destrart: The key. We agree. Here is what we have done to try to show consideration, Run earlier, add mufflers, create sound barriers. The challenge is because the "complainer" is anonymous we are guessing! Not ready to give up but its not looking good. I really am surprised. When you put it in perspective, its 5 months out of the year, one day a week, for three hours. Really?

This is legally correct. I've had several complaints by a lady that lives next to me, when my sisters and I would ride the four wheeler and dirt bike in the trail. She actually took a picture of the four wheeler on the street (turning it around from my driveway) and called the Police. My Cousin is the Chief of Police so we didn't have a problem, and they know me from a dirt bike accident earlier. They said we can ride it in the yard and no one can do anything, EXCEPT late at night where it becomes too loud. At night, we cannot make noise. In the daytime, around 5PM considerably untill around 8PM, we can ride them.

Now, that was when I was younger. Now I know more, such as the Right to Travel, which states 'any automobile, horse and buggy, etc. is allowed to be on the road.' Basically, In the state of Pennsylvania, West Virginia, and Ohio, it's been seen so many times in the court that the 'traveler' (me and you) always wins the court case just because we have the Right to Travel. You can drive it on the road (I'm not sure about the lack of lights and noise, etc). I only know that we have the Constitutional Right to Travel and no penalty can be imposed. If so, you can actually sue the Police Officer for getting in the way of your Rights. ;)

As for noise, it's a different story. Late at night, I'm sure you could get in trouble. It's almost like banks on a Sunday -- it doesn't happen... A rude neighbor and loud noise at midnight...doesn't happen.

My guess, given the location, is that may have a lot to do with the Amish communities in those areas...

By 8pm, most people have had dinner & are relaxing, getting ready to turn in for the night, especially in farming communities/small villages; the last thing they want to hear is a bunch of noisy toys (face it, that's all they are)...

Don't get me wrong, I have go karts, bikes, riding mowers, etc & use them when I can but, within reason. The other day I started my mower at around 5pm (at the moment, it gets dark around 5:30); if it had been much later, I'm sure I would've had complaints...

being considerate is always a good thing..but they could have the consideration to come talk to you themselves..by law , as long as you are on ur property before noise ordinances kick in you are fine..you are in America right??..plus in the summer time here in Wisconsin its light out till b out 9pm...soundsmore like they should get a ticket for wasting tax payers dollars for the reasons they are calling.. it always ends better when a neighbor just talks it out right away

:popcorn: Ehhh, me,...... Well, this is what I'd do..... Almost every state, the law says from 8am to 10pm during the week you can make noise. Weekends affords you 2 more hours, and the noise has to be shut down by midnight. (here, for sure.... :thumbsup:)
So they (your neighbor) say 8pm is TOO late to be riding a kart? It's too loud? You can't sleep? Ok....... :stir::stir::stir:
At 7:45am ,I'm gonna line up all my karts and dirtbikes outside...... Come 8 am, I'm starting them ALL....... And the lawnmower. Gonna rev them, run them..... Make lots of noise. Really get on that (P)ricks nerves. Wait for the cops to show up. THEN tell HIM you have the right to run said equipment, and tend to fully exert that right, EVERY morning. Or until the "anonymous calls" stop and quit wasting taxpayers money on some nonsense. FURTHER MORE, you WILL be contacting the local law makers,city schmucks, and everyone you can to (town council ) and bring it to the attention of the media(news) to the harassment you've been subjected to. And you are just ONE more complaint away from suing him, the city(town) , and the anonymous caller for civil rights infringement!!! The anonymous callers number is recorded so they are NOT anonymous....... :auto: with as much

This would have all been resolved by know if we knew who the "complainer" was. The Sheriff come out every week and says the same three things: 1. Your not breaking the law. 2. Your not doing anything wrong. 3. We don't have a problem with what your doing. The Township Zoning Inspector sent us a letter (page and a half!) Stating they have been "informed" we are running a commercial race track. (I guess that's a compliment!) Sent us a copy of the Noise Control Resolution (NCR) "requesting" that we cease immediately!
Now... it gets dark between 9 and 9:30 out here in the sticks of Ohio, and since the NCR does not state a time,but instead states "a noise disturbance is an unreasonable sound which causes annoyance or disturbance to any person of of ordinary sensitivities" we decided to stop before dark.
Nope! Not the right "guess" since the "complainer won't identify himself so we can stop guessing what would not cause his "ordinary senses" discomfort!
This time 2 sheriff cruisers pull down the lane! 8:30 pm. Really?! The complainer called at 8:02 pm Come on.........
We have an appointment to meet with the Zoning Inspector this week.

May I suggest that you offer the "fella" two complimentary tickets to your race track. Sorry, that was hard to pass up! I hope you get the issue(s) resolved with your neighbors.
